Technology billionaire Elon Musk recently filed a lawsuit against his “ex-wife” for suddenly moving to California while participating in a custody battle in Texas.
Mr. Musk and Canadian singer Grimes have been dating since 2018. Until now, the couple has never announced their marriage. However, their relationship began to be strained from mid-2022, Musk and Grimes continuously announced their separation and reunion.
The 52-year-old billionaire wants to receive joint custody of the child with the female singer. The couple currently has 3 children together, including: boy X Æ A-Xii Musk (2020), girl Exa Dark Sideræl (2021) and boy Tau Techno Mechanicus (2023).
Mr. Elon Musk initially sued singer Grimes in Texas in September 2023, accusing her of “establishing a parent-child relationship” with three children. A few weeks later, the singer sued billionaire Elon Musk in California.
In October 2023, the 35-year-old singer told a judge in Texas that Mr. Musk only had custody of his three-year-old son X Æ A-Xii.
Sharing with The Insider, family law experts said that a trial in California could have major consequences for Mr. Elon Musk because different states regulate child support levels differently.
Mr. Musk only has to pay $2,760 monthly for three children according to the Texas state’s support limit. Meanwhile, the state of California does not regulate this limit. Therefore, it is likely that the richest man in the world will have to pay an extremely high amount of money if the dispute is resolved here.
On November 20, businessman Elon Musk filed an amended petition stating that Texas is the appropriate jurisdiction for the custody battle because this is the children’s home state. Accordingly, the owner of the electric car company Tesla said that Grimes and the three children had resided in Texas for at least 6 consecutive months.
However, Grimes said the three children moved to California to live with her from December 31, 2022.
Experts say it will take billionaire Elon Musk and singer Grimes many months to prove which state the children really “belong” to.
